Access to justice and good governance

Access to justice is more than improving people’s access to courts by ensuring legal representation. Access to justice is defined as the ability of people to seek and obtain remedies through formal institutions with a formal judicial life for complaints in accordance with human rights standards. Where citizens, especially marginalized groups, fear the system, find it alienating and do not have access to it. Access to justice does not exist. Where the justice system is financially inaccessible. Where people do not have a lawyer. Where people lack information and awareness of their rights. Where there is a weak justice system. Access to justice includes normative legal protection, legal awareness, legal aid and advice, enforcement, and civil society monitoring. Access to justice supports sustainable peace because it gives people a more attractive alternative to violence in resolving personal and political disputes.

Considering the importance of access to justice, ARMED also worked with various donor agencies to make people understand that they have easy access to justice and are frustrated with the systems. In April 2014, ARMEO implemented a one-year project called Youth Legal Education Program in Shakarhar province. The main theme of this project was to write a textbook on access to legal justice and good governance. The legal book was written by renowned and professional Afghan writers. After the book was finalized, it was taught to youth and other people from the communities by 39 young volunteers in 14 districts of Nangarhar. The book has very comprehensive information and knowledge on access to justice and good governance. People from different communities appreciated this book very much and asked ARCO to print more and distribute it in other districts and provinces of Afghanistan.
